Description:
Legal document attesting to the decision of the rabbinical court of Pińczów (Pintshev). The case: Baruch lodged a complaint against his neighbor Yitshak ben Shloime Zalman, who had constructed a new window overlooking the courtyard they both shared. He was ordered to remove it, but argued that since Baruch was not presently using the courtyard, and wasn’t affected adversely by the window, it should therefore be allowed to remain since it had already been constructed. The authorities agreed to let it remain, on the condition that if, at some future time, Baruch would desire to expand his house into the courtyard, or construct any building there, Yitshak ben Shloime Zalman would be obligated to stop up the window without objection, acquiring no permanent right to have a window there. The document was signed by Yitshak and by R. Abraham Pinchas Halevi Ish Horowitz, sofer ve-ne’eman (community scribe and trustee).
